The Central Government has established the National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities through an Act of Parliament namely the National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999. As per Section 3(4)(a) of the said Act, the Chairperson of the Trust is to be appointed by the Central Government from amongst the Persons having expertise and experience in the field of autism, cerebral palsy, mental retardation and multiple disability. Section 4(2) of the said Act empowers the Central Government to prescribe conditions of service of Chairperson and other Members of National Trust.

2. The National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities, Rules 2000 published by the Central Government vide notification no. G.S.R. no. 639(E) dated 26.07.2000 presently only provides for salary, dearness allowance and travelling allowance and powers and duties of Chairperson in terms of Section 4(2) of the above said Act. The Rules do not prescribe requisite educational qualification, experience and selection procedure etc. for appointment of Chairperson National Trust. Though the Central Government has been following a transparent mechanism by way of inviting applications through open advertisement for appointment as Chairperson National Trust, it has now been decided to incorporate the qualification, experience and selection procedure for appointment of Chairperson National Trust in the principal Rules.

3. Accordingly, the Central Government has notified today (14.11.2014) the draft of certain Rules further to amend National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Rules, 2000. The proposed amended Rules intend to substitute Rule 4 of the National Trust Rules which inter-alia provides for educational qualifications and experience, required for Chairperson and procedure for selection of Chairperson.
